Legal fight erupts over luxury condo development in Upper Arlington

UPPER ARLINGTON, Ohio (WCMH) — The high-profile effort to redevelop the site of the former Golden Bear shopping center into luxury condominiums, retail and office space has now turned into a legal fight.

Golden Bear Development recently filed a lawsuit seeking a temporary restraining order and a preliminary injunction to stop the City of Upper Arlington from entering or performing work on the property at 3700 Riverside Drive after the city began efforts to make the site compliant with its maintenance codes. The developer argued that the city’s work could interfere with its construction plans for the $100 million-plus mixed-use development.

Franklin County Judge Karen Held Phipps denied the request for a temporary restraining order, which permits the city to continue its activity at the site in the short term. However, the judge did not rule on the request for a preliminary injunction, referring that decision to a magistrate…
