Prosecutors ask to deny accused driver’s motion

DAYTON, Ohio (WDTN) — Prosecutors in the case involving the man accused of causing a crash that killed a child on a school bus in August are wanting a motion denied.

Hermanio Joseph, the accused driver in the deadly Aug. 22 crash that killed 11-year-old Aiden Clark on a Northwestern school bus, filed a motion to dismiss the case. Court documents show the reason Joseph filed a motion to dismiss is because he alleges “the State is not contesting the validity of the Mexican driver’s license.”

The prosecutors are wanting Joseph’s motion to be denied, since prosecutors say the State is saying the license was not valid for a number of reasons:

  • The license was not issued from an approved location.
  • Mexico isn’t a country included in the United Nations treaty regulating international traffic.
  • Joseph resided within the U.S. for over one year without getting a valid driver’s license

Joseph was indicted for Vehicular Homicide and is charged with Involuntary Manslaughter.
