Toledo man granted motion to seek new trial in 2022 murder

TOLEDO, Ohio — A Lucas County judge has granted a man sentenced to life in prison without parole permission to file a motion for a new trial after a new review by the Lucas County Coroner’s Office questioned the original ruling that Erica Cole’s death was a homicide.

Andres Pecina was found guilty on Oct. 17, 2023, of aggravated murder and was sentenced to life in prison without parole.

Pecina’s attorney, David Klucas, filed a motion March 17 asking Lucas County Common Pleas Judge Eric Allen Marks for leave to file a motion for a new trial. It is a necessary legal step before a new trial can be requested. The state did not oppose the request…
