MANGONIA PARK, Fla. (CBS12) — Derrick Marcel McCray, the longtime owner behind McCray’s Backyard BBQ & Seafood, is facing a first-degree felony charge after state investigators accused him of collecting sales tax from customers and failing to turn over nearly $130,000 to the State of Florida.
According to a probable cause affidavit from the Florida Department of Revenue, McCray, 63, of Riviera Beach, was identified as the sole owner and managing member of Derrick Marcel Ventures, LLC, doing business as McCray’s Backyard BBQ & Seafood in Mangonia Park.
Investigators said the business filed sales tax returns showing it collected $150,503.16 in sales taxes from customers between April 2022 and March 2024. However, the affidavit states only $28,612.22 was remitted to the state, leaving an alleged unpaid balance of $129,929.56…
