Man accused of killing Oklahoma County deputy in 2022 faces federal charges

OKLAHOMA CITY (KFOR) — A 38-year-old Oklahoma City man accused of killing an Oklahoma County deputy and injuring another during an eviction attempt in August 2022 is facing multiple federal charges.

According to court documents, on August 22, 2022, three deputies with the Oklahoma County Sheriff’s Office arrived at a home to carry out a court-ordered eviction for 38-year-old Benjamin Harrison Plank. When they arrived, Plank refused to leave the residence, which deputies then prepared to make a lawful forced entry.

Before the deputies could enter, Plank allegedly fired multiple rounds from inside the home with an AR-15 style rifle, killing one of the deputies, later identified as Sgt. Bobby Swartz. He then exited the residence and shot another deputy, later identified as Mark Johns, multiple times. Plank then proceeded to exchange gunfire with the third deputy, Melody Norton.
