HENDERSONVILLE – A 51-year-old Western North Carolina man alleges in a federal lawsuit filed against the Henderson County Sheriff’s Office that two deputies used “excessive” and “disproportionate” force to remove him from his vehicle, assaulting him, breaking his bones, and using a Taser on him while he was unarmed.
The lawsuit, filed June 15 in the United States District Court for the Western District of North Carolina by Hubert Lee Allen, names Sheriff Lowell Griffin and deputies James McClure and Brady Garren as defendants, as well as the sheriff’s insurance company, Western Surety Company.
The defendants have not yet responded to the complaint in court. The Sheriff’s Office declined comment citing the pending litigation, but said all use-of force incidents trigger an automatic review…
