State moves to decertify ARC Baldwin County after safety concerns, critical incidents

LOXLEY, Ala. (NBC 15) — The Alabama Department of Mental Health has moved to decertify ARC Baldwin County, citing repeated safety concerns, failures in care and compliance problems involving Medicaid waiver participants.

In a July 1 letter to ARCBC Executive Director Kathy Fleet, ADMH Commissioner Kimberly Boswell wrote that a “For Cause Review” of the agency began Jan. 7 and ended March 3 following repeated adverse incidents and concerns for the health and safety of Alabama Medicaid waiver participants. The letter says the facility had remained in provisional status since a September 2025 site visit, pending the outcome of that review.

Boswell wrote that the state determined ARCBC programs “do not meet” certification standards. The letter lists several immediate findings, including failure to follow required incident-reporting measures, lack of administrative and executive-level response, inadequate supervision, failure to implement person-centered plans, document deficiencies, staff training deficits, nursing oversight problems and medical care noncompliance.
