Kodak Black is facing a potential legal breakthrough after his attorney Bradford Cohen filed a motion Monday arguing that prosecutors have missed Florida’s mandatory 60-day deadline to file formal charges following his May arrest.
The state had until July 5 to file an information or indictment on the MDMA trafficking charge, and according to Cohen’s filing in Orange County court, that window has closed without any paperwork submitted. Under Florida law, if charges aren’t filed by the 63rd day after arrest, the defendant must be released on their own recognizance unless the state can prove good cause for an extension.
