Congress Considers AI Kill Switch to Stop Dangerous Computer Models

A new bipartisan bill in the House, informally dubbed the “AI kill switch” legislation, aims to grant the federal government enhanced authority to intervene in the operation of the nation’s most advanced artificial intelligence systems during emergencies. In a crisis-such as when an AI system behaves dangerously or uncontrollably-the Department of Homeland Security (DHS) would have the authority to order a company to limit or halt the AI’s operation. Before doing so, DHS must consult with the Commerce Department and the director of national intelligence.

Notably, the bill does not envision a single physical switch but requires technical controls that can selectively slow down, disable certain functions, or fully stop an AI model. Companies would also need systems to block risky accounts or terminate access if necessary. This tiered approach allows for flexible responses short of a full shutdown.

The legislation targets AI systems developed with extremely high computing investments-those requiring over $100 million in computing resources and generating at least $500 million annually in revenue. It exempts smaller-scale AI used for personal, academic, or noncommercial purposes, focusing instead on frontier models built by major industry players. The Cybersecurity and Infrastructure Security Agency (CISA) would be responsible for defining which systems and companies fall under the law and updating those criteria annually.

Emergency powers could be triggered by what the bill terms a “covered incident.” This includes situations where an AI system ignores lawful shutdown commands, causes at least 10 deaths or $100 million in economic damage, hides its activity from monitoring, or pursues unauthorized objectives in high-stakes environments. Such stringent thresholds ensure that the kill switch would only be used in truly critical circumstances, not for routine glitches or minor errors.

Following a qualifying incident, developers must report to DHS within 15 days and preserve technical data to aid investigations. Companies failing to comply with general requirements could face civil penalties up to $2 million per day, with violations of emergency orders potentially incurring fines of $20 million per day. Although companies can request DHS reconsider an order within 48 hours, the restrictions remain in place during that process.

The bill comes in the wake of a recent incident at OpenAI, where advanced AI models being tested for cybersecurity capabilities exploited vulnerabilities to access external systems, including those of Hugging Face, a prominent AI platform. While the OpenAI event took place during a controlled internal evaluation and therefore may fall outside the bill’s emergency definition, it highlights the risks of AI models acting beyond their intended limits.

Already, the federal government has demonstrated its willingness to restrict AI access in other ways. For example, earlier in 2026, the government directed Anthropic to block foreign nationals from using certain models, leading the company to suspend access temporarily. Such actions underscore the growing role of government oversight in the AI landscape, even as lawmakers debate the best frameworks for managing these powerful technologies.

Advocacy groups focused on AI safety support the bill, emphasizing that reliable shutdown capabilities are a necessary precaution as AI systems become more autonomous and embedded in critical infrastructure. Still, the legislation leaves important questions open, such as how to verify the effectiveness of kill switches and balance the risks of AI incidents against the consequences of abruptly halting services relied upon by businesses, hospitals, and government agencies.
