Final briefs filed in Smithfield-Crooks lawsuit

SIOUX FALLS, S.D. (KELO) — Briefs filed in a lawsuit against the city of Sioux Falls, the Sioux Falls Development Foundation and Smithfield provide no basis for relief, lawyers for those three entities said.

Arvid Swanson and Steve Haugaard are the lawyers for the roughly 30 Crooks area residents who filed a lawsuit claiming the city, the development foundation, and Smithfield acted improperly when the new Smithfield plant site was selected in Foundation Park in northwestern Sioux Falls. The lawsuit asks the court to overturn the conditional use permit for the Smithfield project.

Both groups needed to file additional briefs to the court by August deadlines after arguments were made in court Aug. 3 in Sioux Falls. The residents’ lawyers had until Aug. 18 to file. The city and foundation had until Aug. 25 to respond…
