A 72-year-old man was punched and knocked to the ground inside the DeKalb Avenue subway station in Downtown Brooklyn just after 1 a.m. Tuesday, police say, and police are searching for the attacker. The victim was standing near the turnstiles when he was approached and struck, according to police, and he refused medical attention for his injuries at the scene.
The assault, reported by News12 | Brooklyn, remains unsolved as police continue searching for the suspect, whom the report does not identify. Because the victim is over 65 and police say the attacker appears to be more than a decade younger, the case could fall under New York Penal Law § 120.05(12), which elevates an assault on an elderly victim to Assault in the Second Degree — a Class D felony punishable by up to seven years in prison, according to EAGLE.
