Spectrum Retirement Communities, proposing a 142-bed assisted living and memory care facility on land north of the Safeway Plaza in Oro Valley, is prepared to go to court if the town’s Board of Adjustment overturns a zoning code interpretation by town staff.
In a Sept. 2 letter to the Oro Valley Town Council and town management, attorney Alex Hayes of the Phoenix law firm Withey Morris Baugh, PLC, said Spectrum “hopes to continue working constructively with the town and would prefer to devote its and the town’s resources to the standard development review process.
“However, if an appeal is filed, Spectrum is prepared to defend the interpretation before the Board of Adjustment,” he continued…
