The University of Cincinnati filed a response Monday that opposed Texas Tech senior quarterback Brendan Sorsby’s motion to dismiss parts of a lawsuit regarding a breach of contract lawsuit tied to an NIL agreement with the school.
According to records obtained by The Daily Toreador, Cincinnati submitted a brief in opposition on May 18 in the United States District Court for the Southern District of Ohio, arguing that Sorsby’s request to dismiss its claims for liquidated damages and attorneys’ fees should be denied.
“Sorsby now seeks to avoid the consequences of his breaches of the Agreement and the promises he made to the University,” Cincinnati stated in its brief. “He seeks dismissal of the Complaint, claiming that the liquidated damages clause in the Agreement is unenforceable because it is “an unreasonable and disproportionate penalty.”…
