BEAUMONT, Texas — A state district court lawsuit was filed in Houston on Monday evening on behalf of the husband of a Jefferson County Precinct One reserve deputy constable who was killed when a commercial truck struck her patrol vehicle as she directed traffic in a construction zone on Interstate 10 near Winnie.
Troy Stutes of Beaumont filed the suit against SWI Industries of Friendswood, the owner of the commercial truck, and Williams Brothers Construction of Houston, the highway contractor working in the construction zone. The lawsuit also included an injunction to preserve all evidence connected to the crash.
Stutes’ wife, Heather Avery Stutes, 48, was pronounced dead at the scene Friday after a Mack truck struck the rear of her 2022 Ford Explorer at approximately 7:41 a.m. near the 830-mile marker in Chambers County, according to the Texas Department of Public Safety.
