11 charged in Knox County Sheriff’s Office corruption case file motion to dismiss

KNOX COUNTY, Tenn. (WATE) — The people charged in the Knox County Sheriff’s Office corruption case have filed a motion to dismiss, citing pre-indictment delay.

Ten current and former KCSO employees, plus one civilian, were charged with conspiracy to commit theft of property over $250,000, theft of property over $250,000, and theft of services over $60,000.

In the motion, the defendants argued that a virtually identical case had already been presented to a federal grand jury against one of the defendants, former Knox County Narcotics Chief David Henderson, four years ago. Additionally, the alleged criminal conduct was between eight and 16 years ago. The motion argued that this delay would give the state a “tactical advantage” in the case since at least one witness has died and memories of events may have faded.

The motion to dismiss was filed on Monday, arguing that the charges should be dismissed under the Fifth and Fourteenth Amendments to the Constitution as well as Article I, Section 9 of Tennessee’s Constitution. The defendants were arraigned on Wednesday, all pleading not guilty…
