NYC funeral home faces $18M lawsuit after body mix-up

THE BRONX, N.Y. (PIX11) — A New York City funeral home and its owner are being sued after a family claimed that their loved one was put in another man’s casket for a different family’s wake, according to a court document.

According to the complaint released Monday, the family of Jose Luis Diaz, 70, who died in May 2026, instructed the funeral home, R.G. Ortiz Funeral Home on Westchester Avenue, to be cremated directly and not have a viewing.

Instead, his body was dressed in another man’s clothes and presented at a wake intended for a different deceased man.

Furthermore, when the other family attended the wake for the other man, the Funeral Director at the viewing insisted that it was their loved one. That family has since filed a similar lawsuit in August 2026…
