Excessive force, battery claims can proceed in wrongful death suit against Portland police

A wrongful death lawsuit can proceed against Portland police in the fatal shooting of a man who repeatedly fired a pistol into the air from his front deck in 2022, a federal judge has ruled.

U.S. District Judge Adrienne Nelson also refused to grant qualified immunity to the officer involved in the death of Aaron Stanton.

“Here, the evidence in the record is not sufficient to establish that Mr. Stanton actively resisted or evaded arrest, made verbal threats, or took threatening actions toward the police,” Nelson wrote in her ruling on Tuesday…
