A Clackamas County judge dismissed the lawsuit filed against a neighbor, the city of Lake Oswego and the Meadowcreeks at Westwood Homeowners Association over a man’s death during the January 2024 ice storm.
The storm caused a tree to crash through a home in the Westlake area and kill an elderly man named Frank George Ness Jr. The tree fell from the property of his neighbor, Christopher Klock. The storm caused hundreds of trees to fall onto property throughout the month.
The court dismissed the claims with prejudice and without an award of costs or fees to the plaintiff, meaning the case is permanently closed and the plaintiff cannot file the same lawsuit against the defendants again…
