A judge’s decision on whether three teenagers planned to rob another boy instead of selling him a gun will determine whether the oldest defendant’s case is transferred to adult court.
The case stems from the fatal shooting of Jaycieon Bennett last year. Defense lawyer Pete Rost argued Thursday before Lucas County Juvenile Court Judge Amy Stoner that his client, Jose Flores II, gave young Bennett the gun he was buying on behalf of a girl in the same car after receiving payment and therefore was not involved in a robbery.
The fact that Inell Hollie, now 15, fatally shot young Bennett and wounded the girl did not incriminate young Flores for anything beyond selling a gun to a 16-year-old and then discarding its ammunition magazine, which he had retained, when he fled the scene, the lawyer said…
