BOISE, Idaho (CBS2) — Idaho homeowners who say they were hit with undisclosed transfer fees when buying or selling their homes will receive refunds under new court settlements announced today by Attorney General Raúl Labrador.
Labrador said his office reached settlements with two Idaho homeowners’ associations and an HOA management company after receiving complaints that homeowners were charged transfer fees that were never disclosed in their governing documents, which he said violated the Idaho Homeowners Association Act and the Idaho Consumer Protection Act.
Idaho law requires homeowners’ associations to explicitly disclose any transfer fees in their Conditions, Covenants, and Restrictions. Labrador also said management companies have no authority under Idaho law to charge transfer fees…
