EVANSVILLE — A judge has dismissed the lawsuit brought against the City of Evansville after a fire damaged a popular local Downtown restaurant in 2024.
Illinois Casualty Company filed a federal lawsuit against the City of Evansville on Nov. 25, 2025, alleging the Evansville Fire Department left the scene of a fire at Madeleine’s on Dec. 26, 2024, after mistakenly determining the fire was extinguished.
On June 2, United States Magistrate Judge of the Southern District of Indiana Crystal Wildeman dismissed the insurance company’s claim against the city with prejudice, stating the city is immune from the alleged complaint under common law immunity…
