Settlement reached in dispute over CHOOSE Act impacts on high school sports eligibility

MONTGOMERY, Ala. (WHNT) — A legal dispute between Alabama state leaders and the Alabama High School Athletic Association over student-athlete eligibility tied to CHOOSE Act funds has been settled.

On May 29, both sides asked for the case to be dismissed, and a Montgomery County Circuit judge dismissed it with prejudice earlier this month, meaning the same claims cannot be filed again.

The dispute began in 2024 following the passage of the CHOOSE Act which provides state funds to families for non-public school education.  The AHSAA ruled those funds counted as financial aid. This meant, that under longstanding AHSSA rules, students who transferred to a new school using CHOOSE Act money would be required to sit out of athletics for a year…
