Data Center Defendants Challenge Subpoenas to Bradley Arant, Alabama Power

BIRMINGHAM, Ala. (WBMA) — The legal fight over a proposed Birmingham data center has expanded into two new subpoena disputes, with Hoar Construction LLC, Lakeshore Data Center LLC, Nebius Inc. and the City of Birmingham objecting to proposed subpoenas directed at law firm Bradley Arant Boult Cummings LLP and Alabama Power Company.

In court filings entered Oct. 6, the defendants argue that both subpoenas go beyond the discovery authorized by the court for the March 8, 2027, trial.

They also contend the requests seek new evidence after plaintiffs had closed their evidentiary presentation and could reach attorney-client privileged, work-product and other confidential materials…
