FORT MYERS, Florida — The United States has filed a civil complaint against Dr. Kevin Rosenbach, a Naples-based allergy and immunology specialist, alleging fraudulent Medicare claims.
The complaint accuses Dr. Rosenbach and his practice, Kevin P. Rosenbach, M.D. P.A., of knowingly submitting false claims for subcutaneous immune globulins to Medicare Part B. It is alleged that Dr. Rosenbach altered or added diagnoses related to a rare immunodeficiency disease for patients who did not meet the criteria, enabling Medicare Part B coverage, according to a press release from the Department of Justice. This alleged misconduct reportedly resulted in a loss of over $1.9 million to Medicare Part B.
“The United States Attorney’s Office will vigorously pursue and prosecute those who violate the law and compromise the integrity of federally funded programs,” said U.S. Attorney Gregory W.
