Waco, Tx (FOX 44) – Local prosecutors say they are ready to appeal to yet a higher court as an appeals court once again sends a conviction of Marian Fraser into limbo.
The 7th Court of Appeals in Amarillo has reversed the court judgment in the retrial of the day care operator who was charged in the death of an infant who had been given Benadryl while in her care.
Fraser had been charged in the death of Clara Felton while in her care. In the 2023 retrial of the case, prosecutors had successfully argued Fraser gave Benadryl to young Clara at Fraser’s daycare on March 4, 2013. Clara was found in the nap room unresponsive and not breathing. Despite efforts by emergency personnel, she could not be revived…
