Idaho Attorney General Reaches Settlements Over Illegal HOA Transfer Fees

BOISE, ID — Idaho Attorney General Raúl Labrador announced settlements Thursday with two homeowners associations and an HOA management company following complaints that Idaho homeowners were charged undisclosed transfer fees during property sales.

According to the Attorney General’s Office, the settlements involve Pristine Springs Homeowners Association in Ada County, Armstrong Park Homeowners Association in Kootenai County, and Park Pointe Management Services of Ada County. Officials said the fees violated both the Idaho Homeowners Association Act and the Idaho Consumer Protection Act because they were not properly disclosed in governing documents.

Under Idaho law, homeowners associations are required to clearly disclose any transfer fees in their Conditions, Covenants, and Restrictions. The Attorney General’s Office also stated that HOA management companies do not have the legal authority to independently charge transfer fees…
