Carroll Twp. Supervisor Kirby Kitner will not face criminal charges following a decision by the Perry County District Attorney’s Office to withdraw previously filed theft allegations. It was determined the case could not be proven beyond a reasonable doubt.
In a statement, District Attorney Clay Merris said the decision came after a full review of the evidence, including concerns about the reliability of certain witness testimony and deficiencies in township timekeeping practices that made it difficult to establish whether any theft occurred.
“Based on these factors, the Commonwealth determined it could not meet its burden of proof beyond a reasonable doubt,” Merris said in the release, adding that the decision reflects the obligation to pursue only cases that can be proven fairly and ethically in court…
