Homeowners at Heritage Plantation in Madison filed a lawsuit Monday seeking to block their HOA from carrying out a planned culling of the subdivision’s Canada geese population, as a Birmingham attorney argued the birds could be gassed as soon as within the next 48 hours.

Joseph N. Gaines and Dianne Lynn Reed filed the complaint Monday in Madison County Circuit Court against Heritage Plantation Homeowners Association, Inc., alongside a verified ex parte motion for a temporary restraining order. The case has been assigned to Judge Rizzardi, with a hearing scheduled for Wednesday at 1:30 p.m.

Attorney Angie Ingram, who represents the plaintiffs, said the HOA executed a $2,500 contract with the USDA to conduct what the board described as “humane goose capture activities” prior to July 1. But Ingram said the board misrepresented the scope and mandate of the federal agency’s involvement…
