Lawsuit seeks release of records behind North Miami Beach mayor investigation report

An attorney has filed a lawsuit against the city of North Miami Beach demanding access to records used to compile a report about alleged improper communication between the mayor and city staffers.

The lawsuit, filed by the Law Office of Brian H. Pollock on June 30, alleges that North Miami Beach officials have yet to comply with a May 14 public records request for recorded interviews, correspondence and other related materials used by Coral Gables-based Algo Law Firm to compile its 32-page report. Although the report was commissioned to outline improper activities by all seven members of the North Miami Beach City Commission, the only elected official it named was Mayor Michael Joseph.

Pollock’s legal complaint insists that the city has the Algo Law Firm report records stored in an “electric format” and should therefore be transmittable “without delay.” Not transmitting those records, Pollock’s lawsuit added, is a violation of the state’s Chapter 119 public records law.
